Terms and Conditions - Definitions
Unless expressly stated otherwise the following definitions shall apply to the terms used in these terms and conditions:
(1) DC Site Services Ltd whose principal place of business is at Belmont, Wycombe Road Studley Green, High Wycombe, Bucks, HP14 3XB, United Kingdom. Registered in England & Wales, Cardiff 28 May 1993. Company No. 2821530 (hereinafter referred to as "DCSS").
(2) Festival CAT and Festival HAT run on behalf of Festival Republic Ltd by HotBox Studios Ltd whose principal place of business is at 19 The Ridgeway, Bracknell, Berkshire, RG12 9QU, United Kingdom. Registered in England & Wales, Cardiff 25 February 2003. Company No. 04677263 (hereinafter referred to as "CATHAT").
Terms and Conditions - General
These Terms and Conditions apply to DCSS Staff and CATHAT Staff and Volunteers.
If you have any queries regarding the DCSS and CATHAT Terms and Conditions you should contact us in writing before submitting your application.
By completing and submitting an application you are agreeing to abide by the:
- Terms and Conditions;
- Policy & Procedures;
- Code of Conduct;
- Client Rules and Regulations.
By completing and submitting an application form you are agreeing to the submission of your email address to the DCSS and CATHAT mailing lists.
By completing and submitting an application form you are agreeing that any photographs video and sound recordings taken of you or by you may be used by DCSS and CATHAT and the clients of DCSS and CATHAT for any online and offline publicity.
For the safety of general public and staff prior to arrival on-site details of all applicants offered a position are passed to the Police to allow a Police National Computer (PNC) check to be performed.
When working with DCSS and CATHAT you are working under a temporary employment contract. The specifics of positions with DCSS vary depending on the event. The initial briefing and training at each event forms part of your temporary employment contract, as does your agreement to work with us for the duration of the event. Any failure on the employee's part to meet with their terms of employment with DCSS and CATHAT; or policy and procedures of DCSS and CATHAT; or DCSS and CATHAT client’s rules and regulations; will result in forfeit of any remuneration and deposit paid; and result in the requirement to pay any costs to DCSS and CATHAT that may have occurred.
Terms and Conditions - Deposits
Paying a deposit does not mean your position is confirmed for an event.
Deposits are returned in October.
When returning deposits to any applicant where the original deposit was paid online before the 12th May 2008 we are required to deduct 2% rounded up to the nearest GBP.
When returning deposits to any applicant where the original deposit was paid online on or after the 12th May 2008 we are required to deduct 3.4% +20p rounded up to the nearest GBP.
Part or all of your deposit may be withheld if you:
- Do not complete any shift allocated to you;
- Lose any uniform and/or equipment allocated to you;
- Miss your on-site briefing;
- Do not sign-in on-site on the first working day of the event as specified by the application calendar; and do not notify us at least 7 calendar days prior to the first working date of the event as specified by the application calendar;
- Breach the DCSS and CATHAT Terms & Conditions;
- Breach the DCSS and CATHAT Policy & Procedures;
- Breach the DCSS and CATHAT Code of Conduct;
- Breach any DCSS and CATHAT Client Rules and Regulations.
If you do not gain a position due to failing a PNC check your deposit will be returned in October.
If you pay a deposit and cancel your position and notify us in writing at least 7 calendar days prior to the first working date of the event as specified by the application calendar your deposit will be returned in October.
If you pay a deposit and cancel all positions and notify us in writing at least 56 calendar days prior to the first working date of the event as specified by the application calendar subject to a £20.00 GBP administration fee you are eligible for an early deposit return; early deposit returns are processed on a monthly basis.
Terms and Conditions - Employment Rights Act
The following information is a statement of the Terms and Conditions of employment under the employment rights act 1996.
- You are required to carry out your roles and responsibilities as detailed in the job description and position specification.
- Any previous employment with DCSS or CATHAT or any other employer does not form part of a period of continuous employment. Each position is subject to a separate contract of service.
- Your place of work will be the address of the event and is where you are required to work. Details will be given to you on confirmation of position.
- Your employers address is either the DCSS or CATHAT principal place of business.
- You will be paid on the basis of an agreed rate per hour, shift, or event. This rate will be agreed with you at the confirmation of each position. This rate includes i) Holiday pay at a rate of 9.0% ii) Payment of PAYE (where appropriate) iii) Provision of meals or allowances for meals iv) Access to event activity (where appropriate).
- There are no enhancements to stated rates for Sunday or Public Holiday employment.
- Staff are responsible for their own travel and accommodation expenses.
- Provision of meals or allowances are not negotiable and are paid under the discretion of the company directors.
- Your remuneration will be paid to you as agreed at the confirmation of a position. Payments are made in Sterling (British Pound) using one of the following methods: i) At the end of the event for casual staff ii) At agreed weekly or monthly periods for regular staff iii) By cheque made payable only to the named individual member of staff iv) By BACS to an account of the named individual member of staff.
Terms and Conditions - Hours of work
The hours of work are detailed in the specification for each position.
Your employment is for a fixed period linked to each position.
The DCSS and CATHAT working week commences on Sunday.
Your holiday entitlements are calculated at 9.0% per position and are paid to you at the end of each position. You are therefore not entitled to take any further paid holiday periods.
In the case of incapacity for work you will forfeit any offer of employment; and confirmed positions; and receive no remuneration. This is due to the nature of the positions being temporary fixed period.
Neither DCSS nor CATHAT operate any pension schemes to employees contracted under a temporary fixed period.
Your employment contract is for a fixed term and expires at the end of each position.
Your employment and confirmation of position are temporary and can be withdrawn at any time due to any of the following reasons: i) DCSS and/or CATHAT do not gain a contract of services at named event ii) The named event does not take place or is cancelled iii) You are in breach of the DCSS and CATHAT Terms & Conditions; or DCSS and CATHAT Policy & Procedures; or DCSS and CATHAT Code of Conduct; or any DCSS and CATHAT Client Rules and Regulations.
If you are dissatisfied with any disciplinary decision which affects you; you should apply in the first instance to the positions project manager. You should make your application by speaking to the project manager who will document your conversation.
If you have a grievance about your employment you should apply in the first instance to an operations manager. You should make your application in writing.
Terms and Conditions - Access to Venues and Event Sites
All DCSS Staff and CATHAT Staff and Volunteers will be issued with an appropriate pass and/or wristband by the client of whom DCSS and/or CATHAT is providing a service. This pass will enable the wearer to access those areas relevant to the position and responsibilities allocated. When off-shift and where authorised by a License Holder this pass and/or wristband may be used to access and participate within the event's public activities under the Terms and Conditions of the License. Any pass and/or wristband allocated will remain the property of the License Holder at all times.
Any pass and/or wristband is a functional tool DCSS Staff and CATHAT Staff and Volunteers require to carry out their duties. The use of a pass and/or wristband to access and participate in an Event's public activity forms part of the wearers remuneration. Breaching any License Holders Terms & Conditions; Policy & Procedures; Code of Conduct; or Rules and Regulations will also be a breach of your employment Terms and Conditions with DCSS and/or CATHAT.
